Notwithstanding the foregoing, all rights and obligations under this Agreement may be freely assigned by COMPANY to any affiliated entity or any of its wholly owned subsidiaries.
Dispute Resolution
Any legal action of whatever nature brought by either you or us (collectively, the “Parties” and individually, a “Party”) shall be commenced or prosecuted in the courts located in the province of Canda where Spectrum Therapeutic Solutions is located, and the Parties hereby consent to, and waive all defenses with respect to venue and jurisdiction in such courts. Application of the United Nations Convention on Contracts for the International Sale of Goods is excluded from these Terms of Use. In no event shall any claim, action, or proceeding brought by either Party related in any way to the Site be commenced more than one (1) year after the cause of action arose.
Class Action Waiver
You may only resolve disputes with us on an individual basis. Class actions, private attorney general actions, joinder, and consolidation with other arbitrations or proceedings are not allowed.
The decision-maker may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding unless all relevant parties specifically agree to do so.
Severability
If any clause within these Terms of Service is found to be illegal or unenforceable, that clause will be severed from these Terms of Service, and the remainder of these Terms of Service will be given full force and effect.
